Terms of Service
Effective date: August 21, 2026
These Terms of Service (“Terms”) govern your access to and use of Catalist, including our websites, applications, software, and related services (collectively, the “Service”).
These Terms form a legally binding agreement between you and Catalist (“Catalist,” “we,” “us,” or “our”).
By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms. If you do not agree to these Terms, do not use Catalist.
1. About Catalist
Catalist is a personal inventory and collection management service designed to help users record, organize, search, and manage information about things they own or want to keep track of.
Features may include item scanning, manual entry, collections, categories, photos, documents, receipts, files, item metadata, values, search, third-party item lookup, and related functionality. Features may change as the Service develops.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to create a paid Catalist account.
By using Catalist, you represent that you meet these requirements.
3. Your account
You are responsible for:
- Providing accurate account information
- Maintaining the confidentiality of your sign-in credentials
- Activity occurring through your account
- Using reasonable steps to prevent unauthorized access
You may not share account credentials in a way that violates the limitations of your subscription or allows unauthorized users to access the Service.
Notify us promptly at usecatalistapp@gmail.com if you believe your account has been compromised.
We are not responsible for losses caused by your failure to maintain the security of your credentials except where otherwise required by law.
4. Your content
“User Content” means information or materials you submit to Catalist, including inventory records, collections, titles, descriptions, notes, photographs, receipts, documents, files, values, serial numbers, and other information.
You own your content
As between you and Catalist, you retain ownership of your User Content. Using Catalist does not transfer ownership of your User Content to us.
Permission to operate the Service
You grant Catalist a limited, non-exclusive, worldwide license to host, store, copy, process, transmit, display, and otherwise use your User Content only as reasonably necessary to:
- Operate the Service
- Display your information to you
- Process features you request
- Maintain backups
- Protect and secure the Service
- Provide support
- Comply with applicable law
This license does not give Catalist ownership of your User Content.
Your responsibility for content
You represent that you have the rights necessary to upload or store your User Content and that your use of the Service will not violate applicable law or the rights of another person.
Do not use Catalist to store content that you are legally prohibited from possessing or processing.
5. Private inventory
Catalist is designed primarily as a private personal inventory service. Our treatment of your personal information and inventory information is described in our Privacy Policy.
Although we use reasonable measures intended to protect information, no online service can guarantee complete confidentiality, availability, or security.
Do not use Catalist as the sole location for information that you cannot afford to lose.
6. Item information and third-party data
Catalist may obtain item information from third-party databases, APIs, public sources, user contributions, barcode databases, or other sources.
This information may include titles, product names, images, creators, manufacturers, descriptions, release dates, or other metadata. Third-party information may be incomplete, outdated, duplicated, or inaccurate.
Catalist does not guarantee the accuracy, completeness, ownership, availability, or reliability of third-party item information. You are responsible for reviewing information before relying on it.
7. Values, ownership records, and insurance
Catalist may allow you to record values, purchase information, receipts, photographs, serial numbers, or other information concerning personal property.
Unless explicitly stated otherwise, Catalist:
- Is not an appraisal service
- Does not determine the market value of your property
- Does not verify ownership
- Does not authenticate items
- Does not provide insurance
- Does not provide insurance coverage advice
- Does not guarantee that records stored in Catalist will be accepted by an insurer, court, government agency, tax authority, or other third party
Any value shown or stored in Catalist should not be treated as a professional appraisal unless it was independently provided by a qualified professional.
You are responsible for determining what records are appropriate for insurance, tax, legal, estate, or other purposes.
8. Subscriptions and billing
Some Catalist features may require a paid subscription.
Current subscription prices, billing periods, included features, and limits will be shown before purchase.
By purchasing a subscription, you authorize Catalist and its payment processor to charge the applicable fees and taxes using your selected payment method.
Subscriptions may automatically renew unless canceled before the next billing date.
Prices may change in the future. If the price of an existing recurring subscription changes, we will provide notice as required by applicable law before the new price takes effect.
9. Cancellation
You may cancel a recurring subscription through the account or billing controls provided by Catalist.
Unless otherwise stated during checkout:
- Cancellation prevents the subscription from renewing for another billing period.
- You may continue using paid features through the end of the billing period you have already paid for.
- Canceling a subscription does not automatically delete your Catalist account or inventory.
10. Refunds
Except where required by law or expressly stated otherwise at the time of purchase, subscription charges are non-refundable.
If you believe you were charged incorrectly, contact usecatalistapp@gmail.com.
Nothing in this section limits any refund rights you may have under applicable law.
11. Changes to plans and features
Catalist is an evolving product. We may add, modify, replace, or discontinue features.
We may also change storage limits, item limits, plan features, integrations, supported item types, third-party data sources, or other aspects of the Service.
For changes that materially reduce a paid subscription during a period you have already paid for, we will take reasonable steps to provide appropriate notice or another remedy where required by law.
We do not guarantee that any particular feature, integration, item database, API, or third-party service will remain available indefinitely.
12. Acceptable use
You may not use Catalist to:
- Violate any applicable law
- Infringe intellectual property or other rights
- Upload malware or malicious code
- Attempt to gain unauthorized access to accounts or systems
- Circumvent security or access controls
- Interfere with or disrupt the Service
- Scrape or systematically extract data from the Service except through functionality we expressly provide
- Reverse engineer the Service except where such restrictions are prohibited by law
- Impersonate another person
- Use another person’s account without authorization
- Abuse, overload, or intentionally disrupt our infrastructure
- Use the Service to facilitate fraud or other unlawful activity
We may investigate suspected violations and take reasonable action to protect the Service and its users.
13. Catalist intellectual property
Other than User Content and third-party materials, Catalist and the Service, including its software, interface, design, branding, trademarks, graphics, and original content, are owned by Catalist or its licensors and are protected by applicable intellectual property laws.
These Terms give you permission to use the Service. They do not transfer ownership of Catalist intellectual property to you.
You may not copy, reproduce, distribute, sell, license, or create derivative works from Catalist’s proprietary materials except as permitted by law or with our written permission.
14. Feedback
If you voluntarily provide ideas, suggestions, or feedback about Catalist, you authorize us to use that feedback without restriction or compensation to you.
This does not give us ownership of your inventory or other User Content.
15. Third-party services
Catalist relies on and may integrate with third-party services. Those services may have their own terms and privacy policies.
We are not responsible for third-party products or services that we do not control. Changes, outages, restrictions, API limitations, or discontinuation of a third-party service may affect Catalist functionality.
16. Service availability
We work to keep Catalist available and reliable, but we do not guarantee uninterrupted or error-free operation.
The Service may occasionally be unavailable because of:
- Maintenance
- Software errors
- Infrastructure failures
- Security incidents
- Third-party outages
- Internet or telecommunications failures
- Events outside our reasonable control
We may modify, suspend, or discontinue some or all of the Service as permitted by law.
17. Beta and experimental features
Catalist may occasionally provide beta, preview, experimental, or early-access features.
Such features may be incomplete, change substantially, contain errors, or be discontinued.
Unless otherwise expressly stated, beta and experimental features are provided without guarantees regarding availability or continued support.
18. Termination
You may stop using Catalist at any time.
We may suspend or terminate access to the Service if we reasonably believe:
- You materially violated these Terms
- Your use presents a security or legal risk
- Your use threatens the Service or other users
- Payment remains overdue after reasonable attempts to resolve it
- We are legally required to do so
Where practical and appropriate, we will attempt to provide notice before terminating an account for reasons other than serious security, fraud, abuse, or legal concerns.
Sections of these Terms that by their nature should survive termination will remain in effect, including provisions concerning ownership, disclaimers, limitations of liability, and disputes.
19. Disclaimer of warranties
To the maximum extent permitted by law, Catalist is provided “as is” and “as available.”
Catalist disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and any other warranties that may otherwise arise by law, course of dealing, or usage of trade.
We do not warrant that:
- The Service will always be available
- The Service will be error-free
- Data will never be lost
- Third-party information will be accurate
- Catalist will meet every user’s requirements
- The Service will be free from all security vulnerabilities
Some jurisdictions do not allow certain warranty disclaimers, so some of these disclaimers may not apply to you.
20. Limitation of liability
To the maximum extent permitted by law, Catalist and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from or related to the Service.
To the maximum extent permitted by law, Catalist’s total liability arising out of or relating to the Service or these Terms will not exceed the greater of:
- The amount you paid to Catalist during the 12 months before the event giving rise to the claim; or
- $100.
These limitations apply regardless of the theory of liability and even if Catalist has been advised that damages are possible.
Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.
21. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Catalist and its owners, officers, employees, contractors, and affiliates from third-party claims, liabilities, damages, losses, and reasonable expenses arising from:
- Your unlawful use of the Service
- User Content that violates another person’s rights
- Your material violation of these Terms
This obligation does not apply to claims caused by Catalist’s own unlawful conduct.
22. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.
To the extent a dispute may properly be brought in court, you and Catalist agree to the jurisdiction of the applicable state or federal courts with jurisdiction under applicable law, except where consumer law gives you the right to bring a claim elsewhere.
23. Changes to these Terms
We may update these Terms as Catalist develops. When we do, we will update the effective date.
If we make a material change, we will provide reasonable notice when required by law. Changes will apply prospectively.
Your continued use of Catalist after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
24. Entire agreement
These Terms, together with the Privacy Policy and any additional terms presented when purchasing or using a particular Catalist feature, constitute the agreement between you and Catalist regarding the Service.
If any provision is determined to be unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
Our failure to enforce a provision does not waive our right to enforce it later.
